Terms of Service

By creating an account or using aruru.xyz, you agree to these Terms. If you do not agree, do not use the service. Aruru is operated by Przemysław Gołębiewski, Sewan str 128, 10319 Berlin, Germany.

1. The service

Aruru is a software-as-a-service (SaaS) platform for ceramic studios providing studio management tools (kiln management, task tracking, event scheduling, materials, cost tracking, attendance), member management with multi-tenant roles, a community portal (studio and artist discovery, event feed, forum, sponsor directory), and a sponsor portal for ceramic material brands.

Studio owners can export all studio operational data (kiln records, costs, member history, tasks, events) as Excel (.xlsx) at any time from within the application.

We reserve the right to modify, suspend, or discontinue any part of the service with reasonable advance notice for material changes affecting paid subscribers.

2. Accounts and eligibility

2.1 Eligibility

You must be at least 16 years old to use Aruru.

2.2 Account registration

You must provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your credentials and all activity under your account. Notify us immediately at lelekstudio@lelekstudio.com if you suspect unauthorised access.

2.3 One account per person

Each individual may maintain one personal account. You may be a member of multiple studios under the same account. Creating duplicate accounts to circumvent suspensions is prohibited.

2.4 Email verification

Your email must be verified before accessing most features.

3. Studio subscriptions and billing

3.1 Trial period

New studios receive a 14-day free trial from the date of creation. No payment is required to start a trial.

3.2 Subscription plans

After the trial, continued access to studio write operations requires an active paid subscription. Prices are displayed in the application and at aruru.xyz. All prices are in EUR (€).

3.3 Payment

Studio and sponsor subscriptions are processed by Stripe (Checkout and Customer Portal). Card authentication and fraud rules follow applicable EU payment-services law and are applied by Stripe and your payment provider (including strong customer authentication where required). We do not store full card numbers on our servers.

As implemented in our product, billing is initiated from the web Stripe flow (including when opened from the mobile app). We do not use Apple In-App Purchase or Google Play Billing in our application code for these Aruru subscriptions. Refunds and billing disputes for card payments follow Stripe’s processes and these Terms; any future in-store purchase flow would be disclosed separately.

Subscriptions renew automatically unless cancelled before the renewal date.

3.4 Cancellation and refunds

Cancel at any time via Settings → Subscription → Manage subscription. Cancellation takes effect at the end of the current billing period. We do not provide pro-rata refunds for partial periods, except where required by law. Contact lelekstudio@lelekstudio.com within 14 days of a charge you believe was made in error.

3.5 Failed payments

If a payment fails, you have a 30-day grace period before write operations are blocked. Read access is retained during this period.

3.6 Price changes

We will give at least 30 days' notice before price changes apply to your subscription.

3.7 Digital content and consumer contracts (EU)

If you are a consumer in the European Union, mandatory rights under Directive (EU) 2019/770 on certain aspects concerning contracts for the supply of digital content and services (as transposed into your national law) apply alongside these Terms — including rules on conformity, updates where applicable, and remedies. Nothing in these Terms limits those non-waivable rights.

4. Sponsor accounts

4.1 Eligibility

Sponsor accounts are available to businesses and organisations relevant to the ceramics community — including ceramic materials, tools, equipment, glazes, pottery retreats, residency programmes, and galleries. Sponsorship is not available to direct competitors of Aruru.

4.2 Approval

Sponsor registrations are subject to approval. We may approve or reject any application at our sole discretion.

4.3 Sponsor conduct

Sponsor posts must be accurate, relate to ceramics-relevant products or services, and not contain adult content, hate speech, or unlawful material. We may remove posts or suspend accounts that violate these requirements without refund.

4.4 Billing

Sponsor subscriptions are billed monthly via Stripe. The same cancellation and refund terms as section 3.4 apply.

4.5 Transparency

All sponsor content is visually identified as sponsored. We do not use algorithmic promotion or targeted advertising.

5. User content

5.1 Your content

You retain ownership of content you create in Aruru. By submitting content, you grant us a limited, non-exclusive, royalty-free licence to store, display, and transmit it solely for the purpose of providing the service.

5.2 Content standards

You must not submit content that is unlawful, defamatory, harassing, infringes third-party intellectual property rights, contains malware or spam, violates any applicable law, or contains personal data of third parties without their consent.

5.3 Content removal

We reserve the right to remove or restrict content that violates these Terms, applicable law, or community rules. Where we act for illegality or serious breaches, we will state the main grounds where practicable (including in-product notice or email), in line with Regulation (EU) 2022/2065 (Digital Services Act) and our Privacy Policy.

5.4 Community and forum rules

The Aruru forum and community feed are shared spaces. In addition to the content standards in section 5.2, the following rules apply:

We reserve the right to remove content, warn, or suspend accounts that repeatedly or seriously violate these rules. Serious violations (harassment, hate speech, illegal content) may result in immediate permanent suspension without warning.

6. Acceptable use

You agree not to use the service for any unlawful purpose, attempt to gain unauthorised access to other users' data, reverse engineer the service, use automated tools without prior written consent, transmit malware, circumvent rate limits, send unsolicited messages, or impersonate any person or entity.

7. Privacy

Your use of Aruru is governed by our Privacy Policy, which explains how we collect, use, and protect your personal data.

8. Intellectual property

The Aruru name, logo, and all content, design, code, and features are owned by or licensed to us. If you submit feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free licence to use them for any purpose.

9. Disclaimers and limitation of liability

9.1 As-is basis

Aruru is provided on an "as is" and "as available" basis. We make no warranties regarding reliability, accuracy, or fitness for a particular purpose.

9.2 Limitation of liability

To the fullest extent permitted by law, our total liability for any claims arising from these Terms or the service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) EUR 100. We are not liable for indirect, incidental, special, consequential, or punitive damages.

9.3 Exceptions

Nothing limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited by law.

10. Termination

10.1 By you

You may delete your account at any time via Settings → Delete account. Your personal data will be anonymised immediately as described in the Privacy Policy. Active subscription billing will cease at the end of the current billing period.

Studio deletion: if you delete a studio via Studio Settings → Delete studio, all operational data (kiln records, tasks, costs, events, member history) is retained for 90 days before permanent deletion. During the 90-day retention period, contact lelekstudio@lelekstudio.com to request restoration of your studio data. During this period the data is inaccessible to all users. Members lose access immediately upon deletion. You must cancel your Stripe subscription separately via the billing portal — deleting the studio does not automatically cancel your subscription or trigger a refund.

10.2 By us

We may suspend or terminate your account immediately if you materially breach these Terms, engage in conduct harmful to other users, or we are required to do so by law. Where feasible, we will give advance notice and opportunity to export your data.

10.3 Effect of termination

Upon termination, your right to use the service ceases immediately. Sections 5.1, 8, 9, 11, 12, and 13 survive termination.

11. Governing law and disputes

These Terms are governed by the laws of Germany. Disputes are subject to the exclusive jurisdiction of the courts of Berlin, Germany.

If you are an EU consumer, you may also use the EU Online Dispute Resolution platform: ec.europa.eu/consumers/odr.

12. General provisions

13. EU law, app stores, and transparency

This section summarises how specific EU instruments relate to Aruru as we operate it today. It does not replace statutory rights.

13.1 Digital Services Act (DSA)

Regulation (EU) 2022/2065 applies to intermediary services that host user content. We provide a reporting mechanism for forum content, human-led review, and proportionate action. You may contact lelekstudio@lelekstudio.com to appeal a moderation decision. Details are in our Privacy Policy (illegal content and DSA).

13.2 Artificial Intelligence Act

Regulation (EU) 2024/1689 (EUR-Lex) governs certain AI systems placed on the EU market. Our backend does not integrate third-party generative-AI services for moderation or feed personalisation. If we introduce AI features that qualify as regulated AI systems, we will update these documents accordingly.

13.3 Consumer protection and reviews (Omnibus context)

Directive (EU) 2019/2161 (“Omnibus”) strengthens transparency for consumer reviews and pricing in trader–consumer distance contracts. Aruru’s forum is not a verified star-rating system for consumer products like a typical online shop review widget; community posts are user opinions, not vetted purchase reviews. Price display for subscriptions is in the app and on aruru.xyz in EUR.

13.4 Apple App Store and Google Play

Publishing on mobile stores requires compliance with Apple App Store Review Guidelines and Google Play Developer Program Policies (including data-safety and subscription disclosures). You must use the Privacy Policy linked from the store listing. Those policies may impose obligations beyond this document.
